
Anambra2021: Moghalu Drags APC, Andy Uba To Federal High Court, Abuja
There has been internal crisis and numerous court cases in APGA and PDP since their just concluded party primaries. Apparently, APC was not left out.
Dr. George Muoghalu, Managing Director of the National Inland Waterways Authority (NIWA), who was among the 14 aspirants that purchased the APC Governorship forms for the Anambra State Governorship Election has dragged the All Progressive Congress, APC and Andy Uba (the winner of the Primaries as enlisted by INEC), before the Federal High Court, Abuja over an alleged failure of the party to conduct a properly acceptable primary election
In a suit dated and filed on July 8, 2021, the aggrieved aspirant, Moghalu, specifically demanded that the court delists the name of Andy UBAH from the Anambra State Novermber 6 Governorship Election as APC did not conduct any valid primary election on the proposed June 26, 2021.
In the suit which was filled by his lawyer, Mr. Chris Uche, SAN, Moghalu demanded that the All Progressive Congress (APC) should pay him the sum of N22.5 million naira as damages. According to him, the money is meant to be a refund of payment for the expression of interest form and nomination form.
He is also asking the court to order the APC to pay him another sum of N100 million as “exemplary and general damages for the breach of contract to commence and conclude primary election and or breach of Section 87 of the Electoral Act, 2010 (as amended) and the regulations and guidelines of the political party.”
The aspirant, Dr George Moughalu told the court that apart from INEC, whose report stated that APC did not conduct primary election on June 26, that the APC Appeal Panel Committee headed by Gov Inuwa Yaya of Gombe state also stated on their own report that APC did not conduct primaries in Anambra state on June 26.
He is praying the court to declare that Mr. Andy Uba is not a candidate in the forthcoming election because the said primary that produced him as candidate of the APC did not comply with the provisions of the law.
